Sec. 2025. Advanced Manufacturing Innovation Hubs

In this section: The term advanced manufacturing means— a technology, or process that— depends on the use and coordination of information, automation, computation, software, sensing, and networking; makes use of new materials or reuses existing materials; or enhances the manufacturing competitiveness of the United States; research, development, demonstration, and commercial application activities necessary to ensure the long-term, secure, and sustainable supply of advanced materials; or any other innovative energy technology area identified by the Secretary.
The term Hub means an Advanced Manufacturing Innovation Hub established under subsection (b). The term qualifying entity means— an institution of higher education in partnership with industry; an appropriate Federal or State entity, including Federally Funded Research and Development Centers of the Department; a nongovernmental organization with expertise in advanced manufacturing research, development, demonstration, or commercial application activities; or any other relevant entity that the Secretary considers appropriate.
The Secretary shall carry out a program to enhance the manufacturing competitiveness of the United States by making awards to consortia for establishing and operating Advanced Manufacturing Innovation Hubs to conduct and support multidisciplinary, collaborative research, development, demonstration, and commercial application of advance manufacturing technologies. To the maximum extent practicable, each Hub provided an award under this section shall be located at 1 centralized location.
The Secretary shall designate for each Hub a unique advanced manufacturing technology focus, process, or technology. The Secretary shall ensure the coordination of, and avoid unnecessary duplication of, the activities of Hubs with the activities of other research entities of the Department (including the National Laboratories and the Advanced Research Projects Agency—Energy) and industry. To be eligible to receive an award under this section for the establishment and operation of a Hub, a consortium shall— be composed of not fewer than 2 qualifying entities; and operate subject to an agreement entered into by the members of the consortium that documents— the proposed partnership agreement, including the governance and management structure of the Hub; measures to enable the cost-effective implementation of the program under this section; a proposed budget for the Hub, including a description of financial contributions from non-Federal sources; an accounting structure for the Hub that enables the Secretary to ensure that the consortium has complied with the requirements of this section; and a plan to coordinate workforce training within Hub locations.
A consortium seeking to establish and operate a Hub under this section, acting through a prime applicant, shall submit to the Secretary an application that addresses the elements of the consortium agreement required under paragraph (1)(B). If the consortium members are not located at 1 centralized location, an application submitted under subparagraph
(A)shall include a communications plan that ensures close coordination and integration of the activities of the Hub. The Secretary shall select consortia for awards for the establishment and operation of Hubs through a competitive selection process. In selecting consortia under this section, the Secretary shall consider— the information a consortium is required to document under subsection (c)(1)(B); regional diversity; and any existing facilities that a consortium would provide for Hub activities. Awards made to a Hub under this section shall be for a period of not more than 5 years. At the end of the 5-year period of an award under this section, the Secretary may renew the award, subject to a rigorous merit review. Each Hub shall conduct or provide for multidisciplinary, collaborative research, development, demonstration, and, as appropriate, commercial application of advanced manufacturing technologies within the technology development focus for the Hub designated under subsection (b)(3). Each Hub shall— encourage collaboration and communication among the member qualifying entities of the consortium and awardees by conducting activities, to the maximum extent practicable, at 1 centralized location; develop and publish on the website of the Department proposed plans and programs; submit an annual report to the Secretary that summarizes, during the period covered by the report, the activities of the Hub, including— a detailed description of organizational expenditures by the Hub; and a description of each project undertaken by the Hub; and monitor project implementation and coordination. A Hub shall maintain conflict of interest procedures, consistent with the procedures of the Department, to ensure that employees and consortia designees for Hub activities that are in decisionmaking capacities— disclose all material conflicts of interest; and avoid conflicts of interest. The Secretary may disqualify an application or revoke funds distributed to a Hub if the Secretary discovers a failure to comply with conflict of interest procedures established under subparagraph (A). No funds provided under this section may be used for the construction of new buildings or facilities for a Hub. Construction of new buildings or facilities for a Hub shall not be considered as part of the non-Federal share of a cost-sharing agreement of the Hub. Nothing in this paragraph prohibits the use of funds provided under this section, or non-Federal cost share funds, for research or for the construction of a test bed or renovations to existing buildings or facilities for the purposes of research, if the Secretary determines that the test bed or renovations are limited to a scope and scale necessary for the research to be conducted. The Secretary may terminate an underperforming Hub for cause during the award period. The consortium from each Hub, in consultation with the Secretary, may identify best in class technologies that would be eligible for technical assistance, including assistance from loan programs of the Department, the Community Development Financial Institution Program, Small Business Administration loan programs, Small Business Innovation Research and Small Business Technology Transfer programs, and rural energy loan programs of the Department of Agriculture. There is authorized to be appropriated to carry out this section $300,000,000.
