Permission for alterations by a non-Federal interest to a Federal levee, floodwall, or flood risk management channel project and associated features may be granted by a District Engineer of the Department of the Army or an authorized representative. On the date that is 120 days after the date on which the Secretary receives an application for a permit pursuant to section 14 of the Act of March 3, 1899 (commonly known as the Rivers and Harbors Appropriation Act of 1899 ) ( 33 U.S.C. 408 ), the application shall be approved if— the Secretary has not made a determination on the approval or disapproval of the application; and the plans detailed in the application were prepared and certified by a professional engineer licensed by the State in which the project is located.
