Sec. 1036. Modification of congressional notification of sensitive military operations

Section 130f of title 10, United States Code, is amended— in subsection (a)— in the first sentence, by inserting no later than 48 hours after under this title ; and in the second sentence, by inserting and the National Defense Authorization Act for Fiscal Year 2017 before the period at the end; and by striking subsection
(d)and inserting the following: In this section, the term sensitive military operation means an operation— conducted by the United States armed forces outside the United States, whether conducted by the United States acting alone or cooperatively; conducted pursuant to— the Authorization for the Use of Military Force ( Public Law 107–40 ; 50 U.S.C. 1541 ); or any other authority except— a declaration of war; or a specific statutory authorization for the use of force other than the authorization referred to in subparagraph (A); conducted outside a theater of major hostilities; and that is either— a lethal operation; a capture operation; or an activity of self-defense, collective self defense, or in defense of a foreign partner during a cooperative operation. .
