Section 5117 is amended by inserting the following at the end: There is established a Hazardous Materials Approvals and Permits Fund for the administration of special permits and approvals. The Secretary of Transportation shall collect a reasonable fee, to the extent and in such amounts as provided in advance in appropriations acts, for the administration of special permits and approvals, which shall be deposited in the fund established in paragraph (1). The Secretary, after providing notice and an opportunity for public comment, shall issue regulations to implement this subsection and shall establish annual fee rates. .
