Section 5108 is amended by— inserting the following after subsection (a)(2)(B): a person who performs, or is responsible for performing, a function specified by regulation prescribed under this chapter that is required to assure the safe transportation of hazardous material, in commerce, and is subject to the training requirements of section 5107. ; in subsection (a)(3), inserting after material, the following: or perform or be responsible for performing a function specified by regulation prescribed under this chapter that is required to assure the safe transportation of hazardous material, in commerce, and is subject to the training requirements of section 5107, ; in subparagraph (g)(2)(A), by striking and impose by regulation ; and in subparagraphs (g)(2)(B) and (g)(2)(C), replacing

(h).
