Sec. 34101. Authorization of appropriations

The following sums are authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account): For carrying out section 402 of title 23, United States Code— $243,526,500 for fiscal year 2016; $252,267,972 for fiscal year 2017; $261,229,288 for fiscal year 2018; $270,415,429 for fiscal year 2019; $279,831,482 for fiscal year 2020; and $289,482,646 for fiscal year 2021. For carrying out section 403 of title 23, United States Code— $137,835,000 for fiscal year 2016; $140,729,535 for fiscal year 2017; $143,684,855 for fiscal year 2018; $146,702,237 for fiscal year 2019; $149,782,984 for fiscal year 2020; and $152,928,427 for fiscal year 2021.
For carrying out section 405 of title 23, United States Code— $274,720,000 for fiscal year 2016; $277,467,200 for fiscal year 2017; $280,241,872 for fiscal year 2018; $283,044,291 for fiscal year 2019; $285,874,734 for fiscal year 2020; and $288,733,481 for fiscal year 2021. For the National Highway Traffic Safety Administration to carry out chapter 303 of title 49, United States Code— $5,105,000 for fiscal year 2016; $5,212,205 for fiscal year 2017; $5,321,661 for fiscal year 2018; $5,433,416 for fiscal year 2019; $5,547,518 for fiscal year 2020; and $5,664,016 for fiscal year 2021.
For carrying out section 2009 of SAFETEA–LU ( 23 U.S.C. 402 note)— $29,290,000 for fiscal year 2016; $29,582,900 for fiscal year 2017; $29,878,729 for fiscal year 2018; $30,177,516 for fiscal year 2019; $30,479,291 for fiscal year 2020; and $30,784,084 for fiscal year 2021. For administrative and related operating expenses of the National Highway Traffic Safety Administration in carrying out chapter 4 of title 23, United States Code, and this subtitle— $25,755,000 for fiscal year 2016; $26,012,550 for fiscal year 2017; $26,272,676 for fiscal year 2018; $26,535,402 for fiscal year 2019; $26,800,756 for fiscal year 2020; and $27,068,764 for fiscal year 2021.
Except as otherwise provided in chapter 4 of title 23, United States Code, in this subtitle, and in the amendments made by this subtitle, the amounts made available from the Highway Trust Fund (other than the Mass Transit Account) for a program under such chapter— shall only be used to carry out such program; and may not be used by States or local governments for construction purposes. Except as otherwise provided in chapter 4 of title 23, United States Code, and in this subtitle, amounts made available under subsection
(a)for fiscal years 2016 through 2021 shall be available for obligation in the same manner as if such funds were apportioned under chapter 1 of title 23, United States Code. Grants awarded under this subtitle shall be in accordance with regulations issued by the Secretary. If a grant awarded under this subtitle requires a State to share in the cost, the aggregate of all expenditures for highway safety activities made during any fiscal year by the State and its political subdivisions (exclusive of Federal funds) for carrying out the grant (other than planning and administration) shall be available for the purpose of crediting the State during such fiscal year for the non-Federal share of the cost of any project under this subtitle (other than planning or administration) without regard to whether such expenditures were actually made in connection with such project. To receive a grant under this subtitle, a State shall submit an application, and the Secretary shall establish a single deadline for such applications to enable the award of grants early in the next fiscal year. Section 405(a)(1)(G) of title 23, United States Code, is amended to read as follows: Notwithstanding subparagraphs
(A)through (F), the Secretary shall reallocate, before the last day of any fiscal year, any amounts remaining available of the amounts allocated to carry out any of the activities described in subsections
(b)through
(g)to increase the amount made available to carry out section 402, in order to ensure, to the maximum extent possible, that all such amounts are obligated during such fiscal year. .
