Not later than 90 days after the date of the enactment of this Act, the Secretary of the Army shall submit to the congressional defense committees a report setting forth the number of AH–64D Apache helicopters that have been transferred from the Army National Guard to the original equipment manufacturer for the purpose of remanufacture to the AH–64E Apache helicopter variant. The Secretary of the Army shall treat the number of helicopters specified in the report under subsection
(a)as counting against the total number of AH–64 Apache helicopters that may be transferred from the Army National Guard to the regular Army pursuant to subsection
(e)of section 1712 of the Carl Levin and Howard B. Buck McKeon National Defense Authorization Act for Fiscal Year 2015 ( Public Law 113–291 ; 128 Stat. 3668). Nothing in this subsection may be construed to alter or terminate the requirement for a certification by the Secretary of Defense pursuant to subsection
(f)of section 1712 of the Carl Levin and Howard B. Buck McKeon National Defense Authorization Act for Fiscal Year 2015 as a precondition for any action under subsection
(e)of such section.
