Sec. 1204. Authority for acceptance and use of contributions from Kuwait for certain mutually beneficial projects

Subchapter II of chapter 138 of title 10, United States Code, is amended by adding at the end the following new section: The Secretary of Defense, after consultation with the Secretary of State, may accept cash contributions from the State of Kuwait, for the purposes specified in subsection (c). Contributions accepted under subsection
(a)shall be placed in an account established by the Secretary of Defense and shall remain available until expended for the purposes specified in subsection (c). Contributions accepted under subsection
(a)shall be available only for payment of costs in connection with mutually beneficial construction (including military construction not otherwise authorized by law), maintenance, and repair projects in Kuwait. A project shall be considered to be mutually beneficial for purposes of this section if— the project is in support of a bilateral United States and Kuwait defense cooperation agreement; or the Secretary of Defense determines that the United States may derive a benefit from the project, including— access to and use of facilities of the Kuwait Armed Forces; ability or capacity for future posture; and increased interoperability between the Department of Defense and Kuwait Armed Forces. . The table of sections at the beginning of such subchapter is amended by adding at the end the following new item: 2350n. Construction, maintenance, and repair projects mutually beneficial to the Department of Defense and Kuwait Armed Forces. .
