Subtitle B of title XII of the Food Security Act of 1985 ( 16 U.S.C. 3811 et seq. ) is amended by adding at the end the following new sections: The Secretary shall, to the extent possible, inspect annually at least five percent of the lands subject to compliance with highly erodible land conservation plans and for which the owner or operator is receiving a benefit described in section 1211(a), specifically for the purpose of certifying compliance with the highly erodible land conservation plan and eligibility for such benefits.
Not later than March 1 of each year following the year of enactment of this provision, the Secretary shall submit to Congress a report detailing the number of acres inspected for compliance with highly erodible land conservation plans, the number and type of infractions found, and the corrective or enforcement actions, including reviews conducted under section 1215(c) and graduated penalties imposed under section 1212(f), associated with each, including the agency’s justifications for each action.
The report may include other pertinent information regarding compliance and enforcement, as determined by the Secretary. The Secretary shall make available a portion of the administrative and technical assistance funding provided to administer the benefits described in section 1211(a) to be used for technical assistance, monitoring, and enforcement associated with highly erodible land conservation. Funds shall be drawn from each program in proportion to the relative funding of each individual program. .
