Notwithstanding the termination date specified in subsection
(e)of section 834 of the National Defense Authorization Act for Fiscal Years 1990 and 1991 (Public Law 101–189; 15 U.S.C. 637 note), the test program authority provided under such section shall terminate on September 30, 2015, if the Under Secretary for Acquisition, Technology and Logistics certifies to the congressional defense committees not later than December 31, 2014, that— the Department of Defense will not be able to transition all participants in the test program to individual small business subcontracting plans that meet all relevant requirements contained in the Federal Acquisition Regulation before December 31, 2014; or participants transitioned to individual small business subcontracting plans do not enhance subcontracting opportunities for small business concerns.
