Section 104 of title 23, United States Code, is amended— in subsection (a)(1) by striking Administration— and all that follows through the period at the end and inserting Administration $440,000,000 for each of fiscal years 2015 through 2020. ; in subsection (b)— by inserting the national freight program, after highway safety improvement program, ; in paragraphs (1), (2), and
(3)by striking paragraphs

(5)each place it appears and inserting paragraphs (4), (5), and
(6); in paragraph
(4)in the matter preceding subparagraph

(1)through (5)— $400,000,000 for fiscal year 2016; $800,000,000 for fiscal year 2017; $1,200,000,000 for fiscal year 2018; $1,600,000,000 for fiscal year 2019; and $2,000,000,000 for fiscal year 2020. ; and in subsection
(c)by adding at the end the following: For each of fiscal years 2015 through 2020, the amount for each State of combined apportionments for the national highway performance program under section 119, the surface transportation program under section 133, the highway safety improvement program under section 148, the congestion mitigation and air quality improvement program under section 149, the national freight program under section 167, and to carry out section 134 shall be determined as follows: The initial amount for each State shall be determined by multiplying the total amount available for apportionment by the share for each State which shall be equal to the proportion that— the amount of apportionments that the State received for fiscal year 2014; bears to the amount of those apportionments received by all States for that fiscal year. The initial amounts resulting from the calculation under clause
(i)shall be adjusted to ensure that, for each State, the amount of combined apportionments for the programs shall not be less than 95 percent of the estimated tax payments attributable to highway users in the State paid into the Highway Trust Fund (other than the Mass Transit Account) in the most recent fiscal year for which data are available. For each of fiscal years 2015 through 2020, on October 1, the Secretary shall apportion the sum authorized to be appropriated for expenditure on the national highway performance program under section 119, the surface transportation program under section 133, the highway safety improvement program under section 148, the congestion mitigation and air quality improvement program under section 149, the national freight program under section 167, and to carry out section 134 in accordance with subparagraph (A). .
