Sec. 301. Definitions

In this title, the term covered entity means an entity that— is not a forensic science laboratory; and conducts forensic testing, analysis, investigation, identification, or comparisons, the results of which may be interpreted, presented, or otherwise used during the course of a criminal investigation or criminal court proceeding. Not later than 18 months after the date of enactment of this Act, the Board shall submit to the Director a recommended definition of the term relevant personnel , which shall include all individuals who— conduct forensic testing, analysis, investigation, identification, or comparisons, the results of which may be interpreted, presented, or otherwise used during the course of a criminal investigation or criminal court proceeding; or testify about evidence prepared by an individual described in subparagraph (A).
After the Director receives the recommendation of the Board under paragraph (1), the Director shall, in accordance with section 101(f)(3), define the term relevant personnel for purposes of this title.
