Sec. 203. Administration and enforcement of accreditation program

The Director shall determine whether a forensic science laboratory is eligible to receive, directly or indirectly, Federal funds under section 201(a). The Director shall, in consultation with the Board and as appropriate, identify 1 or more qualified accrediting bodies with significant expertise relevant to the accreditation of forensic science laboratories, the accreditation of a forensic science laboratory by which shall constitute accreditation for purposes of section 201(a). The Director shall periodically— reevaluate whether accreditation by a qualified accrediting body identified under subparagraph
(A)is adequate to ensure compliance with the standards and procedures established under this title; and recommend updates to the standards and procedures used by 1 or more qualified accrediting bodies, as necessary. The Director shall provide to the Board, and publish on the Web site of the Office, regular reports regarding— the accreditation of forensic science laboratories by qualified accrediting bodies identified under subparagraph (A); and reevaluations of accreditation by qualified accrediting bodies under subparagraph (B). Not less frequently than once every 5 years, the Director shall evaluate whether a forensic science laboratory that has been determined to be eligible to receive Federal funds under section 201(a) remains eligible to receive Federal funds, including whether any accreditation of the forensic science laboratory by a qualified accrediting body identified under subparagraph
(A)is still in effect. The Director shall develop and maintain on the Web site of the Office an updated list of— the forensic science laboratories that are eligible for Federal funds under section 201(a); the forensic science laboratories that have been determined to be ineligible to receive Federal funds under section 201(a); and the forensic science laboratories that are awaiting a determination regarding eligibility to receive Federal funds under section 201(a).
