Section 1886(h)(2)(D) of the Social Security Act ( 42 U.S.C. 1395ww(h)(2)(D) ) is amended by adding at the end the following new clause: The approved FTE resident amount for a hospital for a cost reporting period beginning during fiscal year 2014 or a subsequent fiscal year shall not be more than the applicable amount for the year. For purposes of subclause (I), the applicable amount for a year shall be an amount equal to 120 percent of the national average salary paid to residents in 2010, updated through the year involved by the Chained Consumer Price Index.
In subclause (II), the term Chained Consumer Price Index means the initial Chained Consumer Price Index for all-urban consumers published by the Department of Labor. .
