(2)the following new paragraph: The Secretary and the entity described in subsection
(b)shall reach agreement on the levels of performance for each of the primary indicators of performance described in section 136(b)(2)(A), taking into account economic conditions, characteristics of the individuals served, and other appropriate factors, and using, to the extent practicable the statistical adjustment model under section 136(b)(3)(A)(viii). The levels agreed to shall be the adjusted levels of performance and shall be incorporated in the program plan. ; and in paragraph (5)(B) (as so redesignated)— by striking grant or contract the first place it appears and inserting grant, contract, or agreement ; by striking under the terms of the grant agreement or contract ; by striking requirement and inserting requirements ; by striking plan described in paragraph

(d)to read as follows: Funds made available under this section and section 127 shall be used to carry out workforce investment activities (including youth workforce investment activities) and provide related assistance for eligible migrant and seasonal farmworkers, which may include— outreach, employment, training, educational assistance, literacy assistance, English language and literacy instruction, pesticide and worker safety training, housing (including permanent housing), supportive services, and school dropout prevention activities; followup services for those individuals placed in employment; self-employment and related business or micro-enterprise development education as needed by eligible individuals as identified pursuant to the plan required by subsection (c); customized career and technical education in occupations that will lead to higher wages, enhanced benefits, and long-term employment in agriculture or another area; and technical assistance to improve coordination of services and implement best practices relating to service delivery through one-stop delivery systems. ; by amending subsection
(f)to read as follows: The Secretary shall establish regulations to carry out this section, including regulations relating to how economic and demographic barriers to employment of eligible migrant and seasonal farmworkers should be considered and included in the negotiations leading to the adjusted levels of performance described in subsection (c). ; in subsection (g), by striking (enacted by the Single Audit Act of 1984) ; and by amending subsection
(h)and deleting subsection
(i)to read as follows: From the funds appropriated and made available to carry out this section, the Secretary may reserve not more than 1 percent for national purposes, such as providing technical assistance to eligible entities. .
