Section 5322 is amended to read as follows: The Secretary, in consultation with the Secretary of Labor, may undertake, or make grants, cooperative agreements, other agreements, or enter into contracts for programs that address human resource needs as they apply to public transportation. A program may include— an employment training program; an outreach program to increase employment of minorities, women, and individuals with disabilities in public transportation activities; research on public transportation personnel and training need; and training and assistance for minority business opportunities.
The Secretary shall undertake, make grants or cooperative agreements, or enter into contracts to establish, conduct and administer a public transportation workforce development program that addresses critical workforce issues and prepares individuals for employment and career pathways in public transportation, including in the area of public transportation technology. Eligible public transportation workforce development programs under this subsection may include apprenticeship programs that are registered under the National Apprenticeship Act ( 29 U.S.C. 50 et seq. ), non-registered apprenticeship programs, skill development programs, skill improvement programs, and on-the-job training programs, that— are, to the extent possible, nationally or regionally significant in scope; replicate a successful workforce development model adopted in multiple geographic locations; target areas with high rates of unemployment; are designed to address current or projected workforce shortages; give priority to minorities, women, individuals with disabilities, veterans, low-income populations and other underserved populations; are designed to provide career pathways that support the movement of targeted populations from initial or short-term employment opportunities to sustainable careers; and other critical activities as identified by the Secretary.
Recipients of assistance pursuant to this subsection shall require that apprenticeship, skill development, skill improvement, and on-the-job training programs utilized to carry out this subsection demonstrate program outcomes including— impact on reducing public transportation workforce shortages in the area served; diversity of training participants; number of participants obtaining certifications or credentials required for specific types of employment; employment outcome, including job placement, job retention, and wages, using performance metrics established in consultation with the Secretary of Labor and consistent with metrics used by programs under the Workforce Investment Act; and to the extent practical, evidence that the program did not preclude workers that are participating in training or apprenticeship activities from being referred to, or hired on, projects funded under this chapter without regard to the length of time of their participation in such program.
Recipients of assistance under this subsection shall— identify the training needs, apprenticeship, skill development programs, and on-the-job training to be implemented at the local level in coordination with entities such as local employers, local transit operators, labor union organizations, Workforce Investment Boards, State workforce agencies, State Apprenticeship Agencies (where applicable), University Transportation Centers, Community Colleges, and community-based organizations representing minority, disability, and low-income populations; and to the extent practicable, conduct local training programs in coordination with existing local training programs supported by the U.S.
Department of Transportation, the U.S. Department of Labor (including registered apprenticeship programs), and the U.S. Department of Education. The Secretary shall conduct research and an impact evaluation based on measurable outcomes of the training, apprenticeship, skill development and skill improvement programs, and on-the-job training funded under this subsection. In the second, fourth and sixth year following the enactment of this subsection, the Secretary shall conduct an aggregate analysis of the national impact related to workforce shortage, diversity, and job placement.
The Secretary may enter into grants, contracts or cooperative agreements, and other agreements, awarded on a competitive basis, to conduct a national public transportation institute to develop and conduct training and educational programs for Federal, State, and local transportation employees, United States citizens, and foreign nationals engaged or to be engaged in Government-aid public transportation work. In cooperation with the Secretary, State transportation departments, public transportation authorities, State workforce agencies, and national and international entities, the institute under paragraph
(1)shall develop and conduct training and educational programs for Federal, State, and local transportation employees, United States citizens, and foreign nationals engaged or to be engaged in public transportation work. The training and educational programs developed under paragraph
(2)may include courses in recent developments, techniques, and procedures related to— intermodal and public transportation planning; management; environmental factors; acquisition and joint use rights-of-way; engineering and architectural design; procurement strategies for public transportation systems; turnkey approaches to delivering public transportation systems; new technologies; emission reduction technologies; ways to make public transportation accessible to individuals with disabilities; construction, construction management, insurance, and risk management; maintenance; contract administration; inspection; innovative finance; workplace safety; and public transportation security. Education and training of Federal, State, and local public transportation employees under this subsection shall be provided— by the Secretary at no cost to the States and local governments for subjects that are a Government program responsibility; or when the education and training are paid under paragraph
(5)of this subsection, by the State, with the approval of the Secretary, through grants and contracts with public and private agencies, other institutions, individuals, and the institute. The Secretary may use up to 1 percent of the amounts made available to carry out this section to administer, oversee, and provide technical assistance for the activities and programs developed and conducted with this section. A grant, cooperative agreement, other agreement, or contract awarded under this section may be up to 100 percent of the cost of the project. Up to 0.5 percent of the amounts made available to a recipient under sections 5307, 5337 and 5339 is available for expenditure by the recipient, with the approval of the Secretary, to pay up to 80 percent of the cost of eligible activities under this section; and A recipient may transfer amounts under paragraph
(1)to existing local training programs supported by the Secretary, the U.S. Department of Labor, and the U.S. Department of Education. . The analysis for chapter 53 is amended by striking the item relating to section 5322 and inserting the following: 5322. Workforce development programs. .
