Sec. 1242. Notification and assessment of proposal to modify or introduce new aircraft or sensors for flight by the Russian Federation under Open Skies Treaty

Not later than 30 days after the date on which the Russian Federation submits to the States Parties to the Open Skies Treaty a proposal to modify or introduce a new aircraft or sensor for flight by the Russian Federation under the Open Skies Treaty, the President shall notify the appropriate committees of Congress of such proposal and the relevant details thereof. Not later than 30 days prior to the date on which the United States intends to agree to a proposal described in subsection (a), the Director of National Intelligence, jointly with the Secretary of Defense and the Chairman of the Joint Chiefs of Staff, and in consultation with the Secretary of State, shall submit to the appropriate committees of Congress an assessment of such proposal on the national security of the United States.
The assessment required by paragraph
(1)shall include a description of any plans of the United States to mitigate the effect of the proposal on the national security of the United States, including an analysis of the cost and effectiveness of any such plans. The assessment required by paragraph
(1)may be submitted in classified or unclassified form as appropriate. In this section: The term appropriate committees of Congress means— the congressional defense committees; the Select Committee on Intelligence and the Committee on Foreign Relations of the Senate; and the Permanent Select Committee on Intelligence and the Committee on Foreign Affairs of the House of Representatives. The term Open Skies Treaty means the Treaty on Open Skies, done at Helsinki March 24, 1992, and entered into force January 1, 2002.
