628.90 Definitions. In this subchapter:
(1)“Exchange” means the American health benefit exchange, as described in 42 USC 18031 .
(2)“Health benefit plan” has the meaning given in s. 632.745
(11).
(3)“Individual navigator” means a natural person, including a natural person who is supervised or employed by an entity, who does all of the following:
(am)Performs any of the activities and duties identified in 42 USC 18031
(i)and 45 CFR 155.210 on behalf of the exchange.
(bm)Receives funding to perform any of the activities and duties identified in 42 USC 18031
(i)and 45 CFR 155.210 on behalf of the exchange.
(3m)“Navigator entity” means an entity or organization that does all of the following:
(a)Employs, supervises, or is affiliated with at least one individual navigator.
(b)Performs, and receives funding to perform, any of the activities and duties identified in 42 USC 18031
(i)and 45 CFR 155.210 on behalf of the exchange.
(4)“Nonnavigator assister” means a natural person who has been designated by the exchange, or could reasonably be described as working at the behest of the exchange, as a nonnavigator assister, including an in-person assister, enrollment assister, application assister, or certified application counselor.
