(1)Except as provided in subsection
(2)of this section, vessels on whitewater rivers proceeding downstream have the right-of-way over vessels proceeding upstream.
(2)In all cases, vessels not under power proceeding downstream on whitewater rivers have the right-of-way over motorized craft underway.
