(ii)capital improvement and renovation of marine recreation land, including periodic dredging in accordance with subsection
(2)of this section, if needed, to maintain or make the facility more useful, or
(iii)matching funds in any case where federal or other funds are made available on a matching basis for purposes described in (a)(i) or

(ii)of this subsection. The board may prescribe further terms and conditions for the making of grants in order to carry out the purposes of this chapter.
(2)For the purposes of this section "periodic dredging" is limited to dredging of materials that have been deposited in a channel due to unforeseen events. This dredging should extend the expected usefulness of the facility for at least five years.
(3)During the 2009-2011 fiscal biennium, the legislature may appropriate such amounts as reflect the excess fund balance in the recreation resource account to the state parks and recreation commission for maintenance and operation of parks and to improve accessibility for boaters and off-road vehicle users. This appropriation is not required to follow the specific distribution specified in subsection (1)(a) and
(b)of this section.
