§ 327. Adulteration
(a)A commercial feed including whole seeds shall be deemed to be adulterated if it bears or contains any poisonous or deleterious substance that may render it injurious to human or animal health, but in case the substance is not an added substance, the commercial feed shall not be considered adulterated under this subsection if the quantity of the substance in the commercial feed does not ordinarily render it injurious to health.
(b)Any other commercial feed, feed supplement, or dosage form animal health product shall be deemed to be adulterated if:
(1)any valuable constituent has been in whole or in part omitted or abstracted from the commercial feed, feed supplement, or dosage form animal health product or any less valuable substance substituted for a more valuable constituent;
(2)its composition or quality falls below or differs from that which it is purported or is represented to possess by its labeling;
(3)use of the product may result in contamination of a raw agricultural product;
(4)it contains a drug and the methods used in or the facilities or controls used for its manufacture, processing, or packaging do not conform to current good manufacturing practice and rules adopted by the Secretary to ensure that the drug meets the requirement of this chapter as to safety and has the identity and strength and meets the quality and purity characteristics that it purports or is represented to possess; or
(5)it contains viable weed seeds in amounts exceeding the limits that the Secretary shall establish by rule. (Added 1985, No. 126 (Adj. Sess.), § 2; amended 2003, No. 42, § 2, eff. May 27, 2003; 2021, No. 41, § 9; 2021, No. 105 (Adj. Sess.), § 56, eff. July 1, 2022.)
