As used in this article, unless the context requires a different meaning:
"Liquefied petroleum gas" means any material that is composed predominately of any of the following hydrocarbons or mixtures of the same: propane, propylene, butanes (normal butane and isobutane) and butylenes.
"Owner" means any person who holds a written bill of sale under which title or ownership to a container was transferred to such person, or any manufacturer of a container who has not sold or transferred ownership thereof by written bill of sale.
"Person" means any person, firm, or corporation.
"Qualifying emergency" means
(i)a state of emergency as declared by the Governor pursuant to Chapter 3.2 (§ 44-146.13 et seq.) of Title 44;
(ii)a local emergency as declared by the local director of emergency management with the consent of the governing body of the political subdivision pursuant to § 44-146.21 ;
(iii)a state of emergency as declared by the President of the United States;
(iv)when severe weather or other similar circumstances exist that may result in a person being placed in imminent danger of death or injury or may result in a building or its fixtures being at risk of significant damage due to lack of heat caused by the lack of sufficient liquefied petroleum gas to produce such heat; or
(v)when a waiver from delivery limitations affecting the delivery of liquefied petroleum gas has been ordered.
