76-9-1303. Befouling waters.
(1)Terms defined in Sections 76-1-101.1 and 76-9-1301 apply to this section.
(2)An actor commits the offense of befouling waters if the actor:
(a)constructs or maintains a corral, sheep pen, goat pen, stable, pigpen, chicken coop, or other offensive yard or outhouse from which the waste or drainage will flow directly into the waters of any stream, well, or spring of water used for domestic purposes;
(b)deposits, piles, unloads, or leaves a manure heap, offensive rubbish, or the carcass of a dead animal from which the waste or drainage will flow directly into the waters of any stream, well, or spring of water used for domestic purposes;
(c)dips or washes sheep in a stream, or constructs, maintains, or uses a pool or dipping vat for dipping or washing sheep in such close proximity to a stream used for domestic purposes by the inhabitants of any city or town so as to make the waters of the stream impure or unwholesome;
(d)constructs or maintains a corral, yard, or vat to be used for the purpose of shearing or dipping sheep within 12 miles of any city or town, from which the refuse or filth from the corral or yard would naturally find its way into any stream of water used for domestic purposes by the inhabitants of any city or town; or
(e)establishes and maintains a corral, camp, or bedding place for the purpose of herding, holding, or keeping cattle, horses, sheep, goats, or hogs within seven miles of any city or town, from which the refuse or filth from the corral, camp, or bedding place will naturally find its way into any stream of water used for domestic purposes by the inhabitants of any city or town.
(3)A violation of Subsection
(2)is a class B misdemeanor.
