53H-1-202. Establishment of initial board membership in 2023.
(1)The governor shall appoint, with the advice and consent of the Senate, individuals to the board, to ensure that the board consists of 10 members with new terms in accordance with this section.
(2)Except for the appointment of the student member described in Section 53H-1-204(3)(c) , the governor shall appoint each individual to a two-year, four-year, or six-year term to ensure that one-third of the members complete the members' terms on June 30 of each odd number year.
(3)Following the appointments described in this section, the governor shall fill a vacancy on the board in accordance with Section 53H-1-204 .
(4)Notwithstanding Section 67-1-2 , for an appointment described in this section:
(a)a majority of the president of the Senate, the Senate majority leader, and the Senate minority leader may waive the 30-day requirement described in Subsection 67-1-2(2) ; and
(b)the Senate is not required to hold a confirmation hearing.
