53E-3-1202. Transferring student enrollment, records, and immunization.
(a)Subject to Subsection
(2), when a school receives the unofficial education record of a transferring student from a school in a sending state, the school shall enroll and appropriately place the transferring student based on the information provided in the unofficial educational record pending receipt and validation of the transferring student's official educational records.
(b)At the time a transferring student is enrolled and conditionally placed based on the student's unofficial educational records under Subsection
(1)(a), the school shall request the student's official educational record from the school in the sending state.
(a)A school enrolling a transferring student under this section shall enroll the transferring student at the same grade level the transferring student has been enrolled at in the school in the sending state regardless of the transferring student's age.
(b)A transferring student that has satisfactorily completed a prerequisite grade level in a school in the sending state shall be eligible for enrollment in the next highest grade level regardless of the transferring student's age.
(a)A school enrolling a transferring student under this section shall give the student 30 days from the day on which the student is enrolled in the school for the student to obtain any immunization that is required by the school.
(b)If the required immunization described in Subsection (3)(a) encompasses a series of immunizations, the initial immunization in the series satisfies the requirement for the student to be immunized within 30 days from the day on which the student is enrolled in the school as required under Subsection (3)(a) .
