31A-22-646.2. Dental services jurisdiction.
(a)Notwithstanding Section 31A-1-103 , an insurer that provides coverage for dental services that are completed in Utah to a patient that is a Utah resident shall comply with all Utah laws related to covered services, non-covered services, and reimbursement for services if 10% or more of the certificate holders or insureds are residents of this state.
(b)Subsection (1)(a) applies regardless of:
(i)the location of the insurer's domicile or principle place of business;
(ii)the location where the dental plan was written, issued, or delivered; or
(iii)a contractual choice-of-law provision.
(a)A signed provider agreement shall govern the contractual rights and obligations of the parties for dental services provided in Utah.
(b)A provider handbook that is provided to a dental provider by an insurer in connection with a provider agreement shall be deemed part of the provider contract.
(c)An insurer may not require a dental provider to comply with a provider handbook or policy that is not provided to the dental provider.
(d)An insurer shall notify a dental provider if the insurer issues a new provider handbook or updates an existing provider handbook.
