This part does not apply to interim storage of nuclear waste if:

(1)the waste:

(a)is produced from a project authorized by the United States Department of Energy;

(b)is from a test reactor; and

(c)is produced at a facility owned by the state; and

(2)the project described in Subsection (1)(a) is permitted and licensed by the division under this title.
