10-7-19. Election to authorize -- Notice -- Ballots.
(1)Subject to Subsection
(2), the board of commissioners or city council of any city, or the board of trustees of any incorporated town, may aid and encourage the building of railroads by granting to any railroad company, for depot or other railroad purposes, real property of the city or incorporated town, not necessary for municipal or public purposes, upon the limitations and conditions established by the board of commissioners, city council, or board of trustees.
(2)A board of commissioners, city council, or board of trustees may not grant real property under Subsection
(1)unless the grant is approved by the eligible voters of the city or town at the next municipal election, or at a special election called for that purpose by the board of commissioners, city council, or board of trustees.
(3)If the question is submitted at a special election, the election shall be held as nearly as practicable in conformity with the general election laws of the state.
(4)The board of commissioners, city council, or board of trustees shall publish notice of an election described in Subsections
(2)and
(3)for the city or town, as a class B notice under Section 63G-30-102 , for at least four weeks before the day of the election.
(5)The board of commissioners, city council, or board of trustees shall cause ballots to be printed and provided to the eligible voters, which shall read: "For the proposed grant for depot or other railroad purposes: Yes. No."
(6)If a majority of the votes are cast in favor of the grant, the board of commissioners, city council, or board of trustees shall convey the real property to the railroad company.
