(a)A judge assigned to the case under section 3105 or 3344 of title 5 U.S.C. (formerly section 11 of the Administrative Procedure Act), shall preside over the taking of evidence in any hearing to which these rules of procedure apply.
(b)The A shall, in writing, promptly notify all parties and participants of the assignment of the judge. This notice may fix the time and place of hearing.
(c)Pending his/her assignment, the responsibilities, duties, and authorities of the judge under these regulations shall be executed by the A, through the Chair or another member of the A designated by the Chair. A Board member shall not serve in this capacity in any proceeding relating to the member, his/her Federal agency, or organization of which he/she is otherwise interested. \[53 FR 39474, Oct. 7, 1988\]
