§ 222.187. Which year's data must an SEA or LEA provide?

(a)Except as provided in paragraph
(b)of this section, the Secretary will determine eligibility under this discretionary program based on student and fiscal data for each LEA from the fiscal year preceding the fiscal year for which the applicant is applying for funds.
(b)If satisfactory fiscal data are not available from the preceding fiscal year, the Secretary will use data from the most recent fiscal year for which data that are satisfactory to the Secretary are available. (Authority: 20 U.S.C. 7707(b))
