§ 1005.405. Borrower residency status.

(a)An eligible Borrower who is an Indian must be:

(1)A U.S. citizen; or

(2)A lawful permanent resident alien.

(b)Documentation must be provided to the Direct Guarantee Lender to support lawful residency status as defined in the Immigration and Nationality Act, codified at 8 U.S.C. 1101, et seq. \[89 FR 20056, Mar. 20, 2024, as amended at 90 FR 42706, Sept. 4, 2025\]
