§ 45.12. Capital.

A covered swap entity shall comply with:

(a)In the case of a covered swap entity that is a national bank or Federal savings association, the minimum capital requirements as generally provided 12 CFR part 3.

(b)In the case of a covered swap entity that is a Federal branch or agency of a foreign bank, the capital adequacy guidelines applicable as generally provided under 12 CFR 28.14. [80 FR 74911, Nov. 30, 2015]
