Chap. LXX.— An Act *for the relief of James Morrow and Jonathan Tipton.* July 27, 1842. *Be it enacted, &c*., That the Secretary of the Treasury pay to James Morrow and Jonathan Tipton, out of any money in the treasury notPayment to them as an indemnity for a certain judgment, &c. otherwise appropriated, the sum of eleven hundred and fourteen dollars and fifty-seven cents, with interest thereon from the twenty-sixth day of October, eighteen hundred and thirty-nine, until the passage of this act, as indemnity for the recovery of damages and costs had against them for a supposed trespass committed while acting, as they have alleged, under the order of the commanding general, in the military service of the United States: *Provided, however*, That the same shall not be paidProviso. until the Secretary of War shall have made examination, and reports to the Secretary of the Treasury that, in his opinion, the said Morrow and Tipton incurred said liability while acting in obedience to a military duty imposed on them while in the public service, and that, in his opinion, they have a just and equitable claim to indemnity from the Government.
