Chap. CLXVI.— An Act *for the relief of Sebastian Butcher, and the heirs and legal representatives of Bartholomew Butcher, Michael Butcher and Peter Bloom.* August 11, 1842. *Be it enacted, &c*., That Sebastian Butcher, and the heirs and legal representatives of Bartholomew Butcher, Michael Butcher, and PeterCertain land confirmed to them. Bloom, be, and they are hereby, confirmed in and to two tracts of land in the state of Missouri, to wit: One tract of four hundred arpens, about six miles from Mine a la Motte, the plat of which is in the land office at Jackson; and another tract of twelve hundred arpens, situated on the waters of Grand or Big River, a plat of which to be produced by them; the claims of the persons aforesaid to these tracts of land having been recommended for confirmation by the commissioners appointed under the “Act for the final adjustment of private land claims in Missouri,”Act of July 9, 1832, ch. 180. approved the ninth day of July, one thousand eight hundred and thirty-two, in their report dated the twenty-seventh of November, one thou-sand eight hundred and thirty-three: *Provided*, That this confirmation Proviso.shall only operate as a relinquishment on the part of the United States to the said tracts of land, and is not intended to affect or interfere with the rights of other persons claiming title thereto; but in the case of the existence of other legal title to said tracts of land, or to any part thereof derived from the United States, by pre-emption or other right, then the said Sebastian Butcher, and the heirs and legal representatives of Bartholomew Butcher, Michael Butcher, and Peter Bloom, be, and they hereby are, authorized to locate a quantity of land equal to that which may have been so taken up from out said claims by virtue of pre-emp-tion or other rights derived from the United States, in legal divisions and subdivisions, not less than half sections, on any of the unlocated lands of the United States in the state of Missouri, now subject to entry at private sale: for which the proper officer of the Government is hereby authorized and directed to issue patents, on the production of a certificate of the register of the land office within whose district such location may be made.
