Ellsworth.Provisions of Employees’ Compensation Act extended to.[39 Stat. 746, 747](/us/stat/39/746/747).[5 U. S. C. §§ 765–770](/us/usc/t5/s765–770). That the provisions and limitations of sections 15 to 20, both inclusive, of the Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes”, approved September 7, 1916, as amended, are hereby waived in the ease of James A.
Ellsworth, of Brooklyn, New York, and the United States Employees’ Compensa52 Stat. 1407tion Commission is authorized and directed to consider and act upon any claim for benefits filed under the provisions of such Act, as amended, within one year after the date of enactment of this Act,Time limitation, filing of claim. by the said James A. Ellsworth on account of injuries alleged to have been incurred by him on January 8, 1933, while he was employed at the United States naval magazine at Fort Lafayette, New York: *Provided*, That no benefits shall accrue prior to the enactment of*Proviso*.No prior benefits. this Act.

June 25, 1938[[S. 2890](/us/bill/75/s/2890)][[Private, No. 742](/us/pvtl/75/742)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the SecretaryClarence Daniel.Payment to guardian of. of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to tire legal guardian of Clarence Daniel, a minor, of Idabel, Oklahoma, the sum of $3,500, in full satisfaction of all claims against the United States for personal injuries received by the said Clarence Daniel when he was struck on May 5, 1937, by a Works Progress Administration truck on United States Highway Numbered 70, near Idabel, McCurtain County, Oklahoma: *Provided*, That no part of the amount*Proviso*.Limitation on attorney’s, etc., fees. appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or agents, attorney or attorneys, on account of services rendered in connection with said claim.
It shall be unlawful for any agent or agents, attorney or attorneys, to exact, collect, withhold, or receive any sum of the amount appropriated in this Act in excess of 10 per centum thereof on account of services rendered in connection with said claim, any contract to the contrary notwithstanding. Any person violating the provisions of thisPenalty for violation. Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000.
