(/us/pvtl/75/740)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, Emmett Lee Payne.Payment to. That the Secretary of the Treasury be, and be is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to Emmett Lee Payne, of Coahoma County, Mississippi, the sum of $5,000, in full settlement of all claims against the Government of the United States for personal injuries and property damage sustained on January 29, 1937, about four miles south of Lula, Coahoma County, Mississippi, on United States Highway Numbered 61, as a result of a collision between the truck driven by the said Emmett Lee Payne and Civilian Conservation Corps service truck numbered 7, bearing *Proviso*.Limitation on attorney’s, etc., fees.United States license numbered 31195–D.
A.: *Provided*, That no part of the amount appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or agents, attorney or attorneys, on account of services rendered in connection with said claim. It shall be unlawful for any agent or agents, attorney or attorneys, to exact, collect, withhold, or receive any sum of the amount appropriated in this Act in excess of 10 per centum thereof on account of services rendered in connection with Penalty for violation.said claim, any contract to the contrary notwithstanding.
Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. Approved, June 25, 1938. That the provisions and limitations of sections 15 to 20, both inclusive, of the Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes”, approved September 7, 1916, as amended, are hereby waived in the ease of James A.
Ellsworth, of Brooklyn, New York, and the United States Employees’ Compensa52 Stat. 1407tion Commission is authorized and directed to consider and act upon any claim for benefits filed under the provisions of such Act, as amended, within one year after the date of enactment of this Act,Time limitation, filing of claim. by the said James A. Ellsworth on account of injuries alleged to have been incurred by him on January 8, 1933, while he was employed at the United States naval magazine at Fort Lafayette, New York: *Provided*, That no benefits shall accrue prior to the enactment of*Proviso*.No prior benefits. this Act.
