CHAP. 29.— An Act To amend the Act entitled “An Act to amend the National Prohibition Act,” approved March 2, 1929. January 15, 1931.[[H. R. 9985](/us/bill/71/hr/9985).][[Public, No. 557](/us/pl/71/557).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, National Prohibition Act, amendment.Vol. 45, p. 1446, amended. That the proviso in the first section of the Act entitled “An Act to amend the National Prohibition Act, as amended and supplemented,” approved March [U.
S. C., Supp. IV, p. 417](/us/usc/p417), amended.2, 1929 (United States Code, Supplement III, title 27, section 91), is hereby amended to read as follows: " “Modification of punishment for violations, etc.Maximum sale.Vol. 41, p. 307.*Provided*, That any person who violates the provisions of the National Prohibition Act, as amended and supplemented, in any of the following ways:
(1)by a sale of not more than one gallon of *Proviso.*No recent or habitual violation.liquor as that word is defined by section 1 of Title II of said Act: *Provided, however*, That the defendant has not theretofore within two years been convicted of a violation of the said Act or is not Small quantity, etc.engaged in habitual violation of the same;
(2)by unlawful making of liquor, as that word is defined by said section, in an amount not Casual employee only.exceeding one gallon, in the production of which no other person is employed;
(3)by assisting in unlawfully making or unlawfully transporting of liquor, as above defined, as a casual employee only; Unlawfully transporting limited quantity, etc.(4) by unlawfully transporting not exceeding one gallon of liquor, as above defined, by a person not habitually engaged or employed in, or not theretofore within two years having been convicted of a, Punishment for.violation of such law, shall for each offense be subject to a fine of not to exceed $500 or to be confined in jail, without hard labor, not to exceed six months, or both.” " Approved, January 15, 1931.
