Digitization Vendor 2025-01-24 70 1 private Chapter 454.— An Act For the relief of the Eagle Transport Company (Limited) and the West of England Steamship Owners' Protection and Indemnity Association (Limited).April 28, 1928.[[S. 3507](/us/bill/70/s/3507).][[Private, No. 100](/us/pvtl/70/100).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the claims Eagle Transport Company (Limited) and the West of England Steamship Owners’ Protection and Indemnity Association (Limited).May bring suit for collision damages to steamship “San Tirso,” in district court.of the Eagle Transport Company (Limited) and the West of England Steamship Owners’ Protection and Indemnity Association (Limited) against the United States for damages anti loss alleged to have been sustained by them as a result of the collision between the British steamship San Tirso and the United States transport Pocahontas, which occurred in Gravesend Bay, New York, on or about December 14, 1917, may be determined in a suit to be brought by the said claimants against the United States in the District Court of the United States for the Southern District of New York, sitting as a court of admiralty and acting under the rules governing such court in admiralty cases, and that said court shall have jurisdiction Jurisdiction of court.to hear and determine the whole controversy and to enter a judgment or decree for the amount of the legal damages, without interest, sustained by reason of said collision, if any such be found to be due either for or against the United States, upon the same principles and measures of liability and with costs, as in like cases in admiralty between private parties and with the same rights of appeal: *Provided*, That such notice of the suit shall be given to the Attorney *Provisos*.Notice, etc., to Attorney General.General of the United States as may be provided by the order of the said court and upon the receipt of such notice it shall be the duty of the Attorney General to cause the United States attorney in the district to appear and defend for the United States: *Provided further*, Commencement of suit.That such suit shall be brought and commenced within four months of the date of the approval of this Act.
