CHAP. 695.— An Act To amend an Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes,” approved September 7, 1916, and Acts in amendment thereof.June 26, 1926.[[S. 3545](/us/bill/69/s/3545).][[Public, No. 432](/us/69/pl/432).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*,Injuries to Government employees.
That section 9 Vol. 39, p. 743, amended.of the Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes,” approved September 7, 1916, and Acts in amendment thereof, is amended to read as follows: " “Medical assistance, etc., at time of injury.That for any injury sustained by an employee while in the performance of duty, whether or not disability has arisen, the United States shall furnish to the employee all services, appliances, and supplies prescribed or recommended by duly qualified physicians which, in the opinion of the commission, are likely to cure or to give relief or to reduce the degree or the period of disability or to Orders from medical officers.aid in lessening the amount of the monthly compensation.
Such services, appliances, and supplies shall be furnished by or upon the order of United States medical officers and hospitals, but where this is not practicable they shall be furnished by or upon the order of private physicians and hospitals designated or approved by the Transportation for treatment, etc.commission. For the securing of such services, appliances, and supplies, the employee may be furnished transportation, and may be paid all expenses incident to the securing of such services, appliances, and supplies, which, in the opinion of the commission, Payment from compensation fund.are necessary and reasonable.
All such expenses when authorized or approved by the commission shall be paid from the employees’ Awards validated.Vol. 39, p. 743.compensation fund. Any award heretofore made by the commission on account of expenses incurred under section 9 of the Act of September 7, 1916, prior to the passage of this Act, shall be valid, if such award would be valid if made on account of expenses incurred under this section after the passage of this Act.” " Sec. 2. Examinations.Vol 39, p. 747, amended.
That section 21 of the Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes,” is amended to read as follows: " “Sec. 21. Submissions to medical examinations required. That after the injury the employee shall, as frequently and at such times and places as may be reasonably required, submit himself to examination by a medical officer of the United States or by a duly qualified physician designated of approved by the commission.
The employee may have a duly qualified physician designated and paid by him present to participate in such Suspension of pay, on refusal.examination. If the employee refuses to submit himself for or in any way obstructs any examination, his right to claim compensation under this Act shall be suspended until such refusal or obstruction ceases. No compensation shall be payable while such refusal or obstruction continues, and the period of such refusal or obstruction shall be deducted from the period for which compensation is payable to him.
Payment to employee for transportation, etc., expenses.“For any examination required by the commission the employee shall be paid all expenses incident to such examination which, in the opinion of the commission, are necessary and reasonable, including transportation and loss of wages incurred in order to submit to examination. All such expenses when authorized or approved by the commission shall be paid from the employees’ compensation fund.” " “Sec. 3. Examination fees.Vol. 39, p. 747, amended.
That section 23 of the Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes,” is amended to read as follows: 773 " “Sec. 23. That fees for examinations made on the part of thePayment to physicians not in Government service. United States under sections 21 and 22 by physicians who are not already in the service of the United States shall be fixed by the commission. Such fees, and any sum payable to the employee under section 21, when authorized or approved by the commission, shall be paid from the employees’ compensation fund.
