That the President of the United States is hereby authorized to issue a patent to Joseph Mayhew, of Bowdoin, Montana, for the northwest quarter of the southwest quarter and lot 12 of section 5, township 30 north, range 32 east, Montana principal meridian, subject to a lien to the United States for the payment of the construction and operation and Conditions.maintenance charges for the Milk River project, Montana, and Vol. 26, p. 891.subject also to the right of way reserved to the United States for ditches and canals under the Act of August 30, 1890 (Twenty-sixth *Proviso*.Claims for damages to be released.Statutes, page 391): *Provided*, That prior to the issuance of such patent, the said Joseph Mayhew and ail other parties having an interest in or a lien upon the north half of the southeast quarter and the southwest quarter of the southeast quarter of section 6, township 30 north, range 32 east, Montana principal meridian, shall release the United States from liability on all present or future claims for damage by seepage to said land in said section 6:
No admission of seepage damages.*And provided further*, That nothing herein shall be construed as an admission that said claims for damage by seepage would be valid, if the United States were liable to suit thereon. Approved, June 17, 1926.
