CHAP. 78.— An Act To amend section 100 of the Judicial Code of the United States. February 14, 1923.[[H.R. 10817](/us/bill/67/hr/10817).][[Public, No. 414](/us/67/pl/414).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*,United States courts.Vol. 39, p. 1187, amended. That section 100 of the Judicial Code is hereby amended to read as follows: " “Sec. 100. Ohio judicial districts. The State of Ohio is divided into two judicial districts to be known as the northern and southern districts of Ohio.
The1247northern district shall include the territory embraced on the 1stNorthern district.Eastern division. day of July, 1910, in the counties of Ashland. Ashtabula, Cuyahoga, Carroll, Columbiana, Crawford, Geauga, Holmes, Lake, Lorain, Medina, Mahoning, Portage, Richland, Summit, Stark, Tuscarawas, Trumbull, and Wayne, which shall constitute the eastern division; also the territory embraced on the date hist mentioned in the countiesWestern division. of Auglaize, Allen, Defiance, Erie, Fulton, Henry, Hancock, Hardin, Huron, Lucas, Mercer, Marion, Ottawa, Paulding, Putnam, Seneca, Sandusky, Van Wert, Williams, Wood, and Wyandot, which shall constitute the western division of said district.
Terms of the district court for the eastern division shall be held at Cleveland on the first Tuesdays in February, April, and October, and at Youngstown on the first Tuesday after the first Monday in March. Terms of theTerms. district court for the western division shall be held at Toledo on the last Tuesday in April and October, and at Lima, if in the opinion of the court the public convenience so requires, on the first Tuesday after the first Monday in September: *Provided*, That suitable *Proviso*.Rooms at Lima.accommodations for holding court at Lima be furnished free of expense to the United States.
“Grand and petit jurors summoned for service at a term of courtJuries, etc., at Cleveland, or Youngstown. to be held at Cleveland may, if in the opinion of the court the public convenience so requires, be directed to serve also at the term then being held or authorized to be held at Youngstown. Grand andAt Toledo or Lima. petit jurors summoned for service at a term of court to be held at 'Toledo may, if in the opinion of the court the public convenience so requires, be directed to serve also at the term then being held or authorized to be held at Lima.
“Crimes and offenses committed in the eastern division shall beCriminal actions. cognizable at the terms held at Cleveland or at Youngstown, as the court may direct. Crimes and offenses committed in the western division shall be cognizable at the terms held at Toledo or at Lima, as the court may direct. “Any suit brought in the eastern division may, in the discretionDiscretionary places of trials. of the court, be tried at the term held at Youngstown. Any suit brought in the western division may, in the discretion of the court, be tried at the term held at Lima.
“The southern district shall include the territory embraced on theSouthern district.Western division. 1st day of July, 1910, in the counties of Adams, Brown, Butler, Champaign. Clark, Clermont, Clinton, Darke, Greene, Hamilton, High- land, Lawrence, Miami, Montgomery, Preble, Scioto, Shelby, and Warren, which shall constitute the western division; also theEastern division. territory embraced on the date last mentioned in the counties of Athens, Belmont, Coshocton, Delaware, Fairfield, Fayette, Franklin, Gallia, Guernsey, Harrison, Hocking, Jackson, Jefferson, Knox, Licking, Logan, Madison, Meigs, Monroe, Morgan, Morrow, Muskingum, Noble, Perry, Pickaway, Pike, Ross, Union, Vinton, and Washington, which shall constitute the eastern division of said district.
“Terms of the district court for the western division shall beTerms. held at Cincinnati on the first Tuesdays in February, April, and October; and for the eastern division at Columbus on the first Tues- days in June and December, and at Steubenville on the first Tuesdays of March and September. Grand and petit jurors summoned forJuries. etc., at Columbus or Steubenville. service at a term of court being held at Columbus may, if in the opinion of the court the public convenience so requires, be directed to serve also at the term being held or authorized to be held at Steubenville.
Crimes and offenses committed in the eastern divisionCriminal actions. shall be cognizable at the terms held at Columbus, or at Steubenville, as the court may direct. Any suit brought in the eastern divisionTrials at Steubenville. may, in the discretion of the court, be tried at the term held at1248*Provisos*.Rooms to be furnished.Steubenville: *Provided*, That suitable rooms and accommodations for holding court at Steubenville shall be furnished free of expense to the Government until the completion of the Federal building: *And provided further*, Terms, etc., at Dayton.That terms of the district court for the southern district shall be held at Dayton on the first Mondays in May and November.
Prosecutions for crimes and offenses committed in any part of said district shall also be cognizable at the terms held at Dayton. All suits which may be brought within the southern district, or either division thereof, may be instituted, tried, and determined at the terms held at Dayton.” " Approved, February 14, 1923.
