CHAP. 435.— An Act Validating certain applications for and entries of public lands. September 22, 1922.[[H.R. 10419](/us/bill/67/hr/10419).][[Private, No. 146](/us/67/pv/146).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the Secretary of thePublic lauds.Homestead, etc., patents to be issued. Interior be, and he is hereby, authorized to issue patents upon the entries hereinafter named upon which proof of compliance with law has been filed, upon the payment of all moneys due thereon:

Homestead, etc., entries validated, etc. That the entries hereinafter named be, and the same are hereby, validated, and the Secretary of the Interior authorized to issue patents thereon upon submission of satisfactory proof of compliance with the law under which such entries were allowed:

Forest on January 10, 1920, for the southeast quarter of the northeast quarter, section twenty-three, township fourteen north, range four east, Gila *Proviso*.Purchase price, etc.and Salt River meridian: *Provided*, That the payment of $1.25 per acre required under the provisions of the desert-land law shall be in1761lieu of the like amount at which this land was appraised when open to entry.

Sec. 3. That the Secretary of the Interior be, and he is hereby,Homestead application authorized. authorized to allow the following application to make entry: Homestead application, Phoenix, Arizona, numbered naught Frank D. Thomas.thirty-nine thousand five hundred and seventy-one, filed by Frank D. Thomas, for the north half of the southeast quarter, section nine, township one south, range two east, Gila and Salt River meridian, subject to the reclamation law, and to allow said entryman, in complying with the requirements of the homestead laws, credit for his residence upon, improvement, and cultivation of said land prior to the date of this Act.
Sec. 4. That the Secretary of the Interior be, and he is hereby,Mary E. Battles.Acceptance of residence of, on homestead entry of husband. authorized to accept proof of residence of Mary E. Battles, formerly Mary E. Burdett, upon the homestead entry of her husband, Albert L. Battles, in lieu of residence upon her homestead entry, Portland, Oregon, numbered naught fifty-four hundred and seventy-three, made August 7, 1918, for the northwest quarter of section eleven, township seven south, range two east, Willamette meridian, in conformity with the election filed by her husband under the provisions of the Act of April 6, 1914 (Thirty-eighth Statutes at Large, page 312).Vol. 38, p. 312.
Sec. 5. That the Secretary of the Interior is authorized to issue aEdwin Gartner.Homestead patent to. patent to Edwin Gantner upon homestead entry, Newcastle, naught twenty-five thousand three hundred and four, embracing the west *Post*, p. 1768.one-half section twenty-six and the north one-half section twentyseven, township fifty-two north, range seventy-four west, sixth principal meridian, made by said Edwin Gantner, without requiring further residence. Sec. 6. That the Secretary of the Interior be, and he is hereby,Otha Potter.Homestead application of, allowed as heir to Rufus A.
Potter. authorized and directed to allow the additional homestead application of Otha Potter, Havre, Montana, numbered naught forty-six thousand two hundred and ninety-seven, as heir and legal representative of Rufus A. Potter, who was killed in action during the war with Germany, for the northwest quarter, the northwest quarter of the southeast quarter, the northeast quarter of the southwest quarter of section twenty-six, the south half of the south half of section twenty-three, and the east half of the northeast quarter of section twenty-seven, township twenty-four north, range twenty-three east, Montana principal meridian, subject to the Act ofVol. 40, p. 248.
