CHAP. 260.— An Act Amending section 97 of the Act entitled “An Act to codify, revise, and amend the laws relating to the judiciary,” approved March 3, 1911. July 1, 1922.[[H. R. 6110](/us/bill/67/hr/6110).][[Public, No. 265](/us/pl/67/265).] *Be it enacted the Senate and House of Representatives of the United States of America in Congress assembled*, United States courts. Vol, 36, p. 1119. Vol. 41, p. 394, amended. That section 97 of the Act entitled “An Act to codify, revise, and amend the laws relating to the judiciary,” approved March 3, 1911, be, and it is, amended so as to read as follows:
" “Sec. 97. New York judicial districts. The State of New York is divided into four judicial districts, to be known as the northern, eastern, southern, and western Northern district.districts of New York. The northern district shall include the territory embraced on the 1st day of July, 1910, in the counties of Albany, Broome, Cayuga, Chenango, Clinton, Cortland, Delaware, Essex, Franklin, Fulton, Hamilton, Herkimer, Jefferson, Lewis, Madison, Montgomery, Oneida, Onondaga, Oswego, Otsego, Rensselaer, Saint Lawrence, Saratoga, Schenectady, Schoharie, Tioga, Tompkins, Warren, and Washington, with the waters thereof.
Terms.Terms of the district court for said district shall be held at Albany on the second Tuesday in February; at Utica on the first Tuesday in December; at Binghamton on the second Tuesday in June; at Auburn on the first Tuesday in October; at Syracuse on the first Tuesday in April; and, in the discretion of the judge of the court, one term annually at such time and place within the counties of Schenectady, Rensselaer, Saratoga, Onondaga, Saint Lawrence, Clinton, Jefferson, Oswego, and Franklin, as he may from time to time appoint: *Provided,* That suitable accommodations for holding *Proviso*.
Free court accommodations, etc.court at such appointed place be furnished free of expense to the United States. Such appointment shall be made by notice of at least twenty days, published in a newspaper published at the place Eastern district.where said court is to be held. The eastern district shall include the territory embraced on the 1st day of July, 1910, in the counties of Richmond, Kings, Queens, Nassau, and Suffolk, with the waters Terms.thereof. Terms of the district court for said district shall be held at Southern district.Brooklyn on the first Wednesday in every month.
The southern district shall include the territory embraced on the 1st day of July, 1910, in the counties of Columbia, Dutchess, Greene, New York, Orange, Putnam, Rockland, Sullivan, Ulster, and Westchester, with 813the waters thereof. Terms of the district court for said district shallTerms. be held at New York City on the first Tuesday in each month. The Concurrent jurisdiction of eastern and southern districts. [R. S., sec. 512, p. 91](/us/rs/s512/p91).district courts of the southern and eastern districts shall have con-current jurisdiction over the waters within the counties of New York, Kings, Queens, Nassau, Richmond, and Suffolk, and over all seizures made and all matters done in such waters; all processes or orders issued within either of said courts or by any judge thereof shall run and be executed in any part of said waters.
The western districtWestern district. shall include the territory embraced on the 1st day of July, 1910, in the counties of Allegany, Cattaraugus, Chautauqua, Chemung, Erie, Genesee, Livingston, Monroe, Niagara, Ontario, Orleans, Schuyler, Seneca, Steuben, Wayne, Wyoming, and Yates, with the waters thereof. Terms of the district court for said district shall be held atTerms. Elmira on the second Tuesday in January; at Buffalo on the second Tuesdays in March and November; at Rochester on the second Tuesday in May; at Jamestown on the second Tuesday in July; at Lockport on the second Tuesday in October; and at Canandaigua on the second Tuesday in September.
The regular sessions of the districtBankruptcy and admiralty proceedings, etc., at Buffalo. court for the western district for the hearing of motions, and for proceedings in bankruptcy and the trial of causes in admiralty, shall be held at Buffalo at least two weeks in each month of the year, except August, unless the business is sooner disposed of. The times for holding the same and such other special sessions as the court shall deem necessary shall be fixed by rules of the court.
All process in admiralty causes and proceedings shall be made returnable at Buffalo. The judge of any district in the State of New York may perform Interchange of judges.the duties of the judge of any other district in such State upon the request of any resident judge entered in the minutes of his court: and in such cases such judge shall have the same powers as are vested in the resident judge.” " Approved, July 1, 1922.
