CHAP. 118.— An Act For the relief of Lowe Hayden Bibby. February 26, 1923.[[S. 3690](/us/bill/67/s/3690).][[Public, No. 445](/us/pl/67/445).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the President Navy.Lowe Hayden Bibby may be appointed an ensign.of the United States is hereby authorized to appoint, by and with the advice and consent of the Senate, Lowe Hayden Bibby, who graduated from the United States Naval Academy on June 2, 1922, an ensign in the United States Navy, to rank next after Ensign Robert McCormick Peacher: *Provided*, That such appointment *Proviso*.Time of appointment, etc.shall be regarded, to all intents and purposes, as having been made upon his graduation from the United States Naval Academy, and as though his resignation which became effective June 2, 1922, had not been accepted, but that he shall not be entitled to receive any pay or allowances for the time he has not been in active service.
