CHAP. 1.— An Act To permit Mahlon Pitney, an Associate Justice of the Supreme Court of the United States, to retire. December 11, 1922.[[S. 4025](/us/bill/67/s/4025).][[Public, No. 367](/us/67/pl/367).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the provisions of theSupreme Court.Mahlon Pitney, asso ciate justice or, permitted to retire.Vol, 40, p. 1157. Judicial Code, section 260, as amended by the Act of February 25, 1919, chapter 29, section 6, be, and they are hereby, extended and made applicable to Mahlon Pitney, an Associate Justice of the Supreme Court of the United States, in consequence of his physical disability, notwithstanding he has not attained the age of seventy years as required by the aforesaid provisions: *Provided, however*, That the*Proviso*.Resignation required. said Mahlon Pitney shall resign the said office of Associate Justice of the Supreme Court of the United States within two months after the passage of this Act.
