XXXIII.— An Act to amend an act, entitled “An act for the establishment of a turnpike company in the county of Alexandria, in the District of Columbia.”April 9, 1824. *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That,During the continuance of the act of April 21, 1808, ch. 50, the Washington and Alexandria turnpike company may demand, at the bridge over the Four Mile Creek, one cent for each foot passenger.Proviso. during the continuance of the act, entitled “An act for the establishment of a turnpike company in the county of Alexandria, in the District of Columbia,” passed the twenty-first April, one thousand eight hundred and eight, the Washington and Alexandria turnpike company shall be entitled to demand and receive, by their proper agents, servants, or officers, at the bridge built by said company, over Four Mile Creek, between the town of Alexandria and the city of Washington, the sum of one cent from each and every person passing on foot over said bridge; *Provided always, and it is further enacted,* That, whenever the net proceeds of tolls collected on said road and bridge shall be sufficient to defray the expense of rebuilding the bridge on Four Mile Run, keeping said bridge and road in a sufficient state of repair, and allow the stockholders dividends, at the rate of six per centum per annum, then, and in that case, the circuit court of the District of Columbia for the county of Alexandria shall determine that the right of said company to demand the tolls prescribed by this act, or any other tolls, from foot passengers, shall cease.
