CHAP. 45.— An Act To authorize the Secretary of the Interior to withdraw from the Treasury of the United States the funds of the Kiowa, Comanche, and Apache Indians, and for other purposes. August 22, 1911.[[H. R. 13002](/us/bill/62/hr/13002).][[Public, No. 44](/us/pl/62/44).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, * That the Secretary of theKiowa, Comanche, and Apache Indians, Okla.Use of trust funds for benefit of.
Interior be, and he is hereby, authorized, in his discretion, to withdraw from the Treasury of the United States so much of the trust funds of the Kiowa, Comanche, and Apache tribes of Indians in Oklahoma as he may deem necessary for expenditure for the benefit of such Indians, not to exceed four hundred thousand dollars, prior to the first day of May, nineteen hundred and twelve, and use such funds for the benefit of said Indians to such extent as he may deem proper, prior to the first day of May, nineteen hundred and twelve: *Provided,* That the Secretary*Provisos*.Report. of the Interior shall report to Congress as early as practicable the amount of such funds so withdrawn and so used for the benefit of said Indians: *And provided further,* That if any of said funds so withdrawnDeposit of funds not used. shall not have been used for the benefit of said Indians prior to 34the first day of May, nineteen hundred and twelve, the same shall be redeposited in the Treasury of the United States: *And provided further,*Four per cent fund excepted.Vol. 34, pp. 213, 550.Vol. 35, pp. 41, 49, 636.Vol. 36, p. 266.
That this Act shall not apply to the Apache, Kiowa, and Comanche four per centum fund of approximately two million six hundred thousand dollars now on deposit in the United States Treasury under the Act of June fifth, nineteen hundred and six (Thirty-fourth Statutes at Large, page two hundred and thirteen), and subsequent Acts of Congress.
