CHAP. 111.— An Act To provide for the extension of New Hampshire Avenue, in the District of Columbia, on a straight line, and for other purposes.March 3, 1913.[[S. 2504](/us/bill/62/s/2504).][[Public, No. 413](/us/pl/62/413).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*,District of Columbia.New Hampshire Avenue.Condemning land for extending. That within six months after the passage of this Act the Commissioners of the District of Columbia be, and they are hereby, authorized and directed to institute in the Supreme Court of the District of Columbia, sitting as a district court, under and in accordance with the provisions of subchapter one ofVol. 34, p. 151. chapter fifteen of the Code of Law for the District of Columbia, a proceeding in rem to condemn the land that may be necessary for the extension of New Hampshire Avenue on a straight extension of the lines thereof as now established in the city of Washington from its present terminus north of Buchanan Street to the District line, with a uniform width of one hundred and twenty feet: *Provided, however*,*Provisos*.Damages assessed as benefits.
That the entire amount found to be due and awarded by the jury in said proceedings as damages, for and in respect of the land to be condemned for said extension, plus the costs and expenses of said proceeding, shall be assessed by the Jury as benefits: *And provided further*,Restriction. That nothing in said subchapter one of chapter fifteen of said code shall be construed to authorize the jury to assess less than the aggregate amount of the damages awarded tor and in respect of the land to be condemned and the costs and expenses of the proceedings hereunder.
Sec. 2. That there is hereby appropriated, out of the revenues ofAppropriation for expenses. the District of Columbia, an amount sufficient to pay the necessary costs and expenses of the condemnation proceedings taken pursuant hereto and for the payment of amounts awarded as damages, to bePayment of awards. repaid to the District of Columbia from assessments for benefits and covered into the Treasury to the credit of the revenues of the District of Columbia. Sec. 3. That the Commissioners of the District of Columbia areHighways system modified. hereby directed to change the plans for a permanent system of highways outside the city of Washington so as to abandon the extension of New Hampshire Avenue from Buchanan Street northward to the District line, as at present laid down on said plans.
