CHAP. 474.— An Act To satisfy certain claims against the Government arising under the Navy Department. June 25, 1910. [[H. R. 22539](/us/bill/61/hr/22539).] [[Private, No. 163](/us/pvtl/61/163).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* Navy Department. Payment of certain claims. That the following sums be, and the same are hereby, appropriated, out of any money in the Treasury not otherwise appropriated, to pay the claims arising under the Navy Department hereinafter stated, the same being in full for and the receipt of the same to be taken and accepted in each case as a full and final release and discharge of the respective claims, namely:
To pay Sucesores de Abarca, San Juan, Porto Rico, the cost ofSucesores de Abarca. repairs to the American steamship Evelyn, made necessary on account of a collision with the United States ship Peoria at the naval1871 station, San Juan, on February eighteenth, nineteen hundred and six, fifty-eight dollars. To reimburse Paymaster Frederick K. Perkins, United StatesFrederick K. Perkins. Navy, the amount disallowed by the Auditor for the Navy Department on account of wrong payment of salary to Mr.
J. F. MacGrail, late chaplain, United States Navy, thirty-four dollars and forty-five cents. To pay the owners of the American ship Erskine M. Phelps damages“Erskine M. Phelps,” ship. resulting from a collision with the United States ship Alexander at the United States naval station, Cavite, Philippine Islands, on November twenty-seventh, nineteen hundred and six, fifty dollars. To reimburse Passed Assistant Paymaster B. M. Dobson, UnitedB. M. Dobson. States Navy, the amount checked against his account by reason of the payment by him for the damages inflicted by the floating dry dock Dewey to the sea wall at Las Palmas, Canary Islands, on February twenty-third, nineteen hundred and six, thirty-four dollars and seven cents.
To pay H. L. White, Norfolk, Virginia, for damages to his yawlH. L. White. Mattacheesett as the result of a collision with a navy steam launch in Hampton Roads on April sixteenth, nineteen hundred and seven, sixty dollars. To pay the owners of the German steamship Wangard demurrage“Wangard,” steamship. while effecting repairs caused by a collision with the United States ship Saturn at Mare Island, California, on May thirteenth, nineteen hundred and seven, two hundred and twenty dollars and eight cents.
To pay A. G. Vanderbilt, New York, New York, owner of theA. G. Vanderbilt. sailing yacht Caprice, for damages sustained in a collision with a naval barge in the harbor at Newport, Rhode Island, on May thirty-first, nineteen hundred and seven, two hundred and sixty-five dollars and forty-seven cents. To pay George Bellas, of Newport, Rhode Island, for damagesGeorge Bellas. sustained in a collision between his sailing skiff and the United States ship Chickasaw in the harbor at Newport, Rhode Island, on July thirteenth, nineteen hundred and seven, twenty-six dollars and twenty-five cents.
To pay Thomas W. Smith, Washington, District of Columbia, forThomas W. Smith. damages as the result of the United States ship Tecumseh colliding, on August fifth, nineteen hundred and seven, with a wharf owned by him, forty-six dollars and eighty cents. To reimburse Paymaster Charles Conard, United States Navy,Charles Conard.Advertising. on account of the advertising of the sale of certain condemned government property, twenty-nine dollars and forty-five cents. To reimburse Paymaster Charles Conard, United States Navy, theCollision damages, Cavite, P.
I. amount checked against his account by the Auditor for the Navy Department, by reason of the payment by him for the repairs to a private launch damaged in a collision with a navy launch in the harbor at Cavite, Philippine Islands, during nineteen hundred and four, twelve dollars and ninety-seven cents. To pay damages as the result of a collision between the United“Prosper,” steamship. States ship Nanshan and the Norwegian steamship Prosper in the harbor at Hankow, China, on October fifteenth, nineteen hundred and seven, eighty-tliree dollars and thirty-two cents.
To pay the Miner Engineering Company, Washington, District ofMiner Engineering Company. Columbia, damages as the result of the United States ship Mayflower cutting a pipe line operated from their dredge anchored in the Eastern Branch of the Potomac River on November thirtieth, nineteen hundred and seven, one hundred and five dollars. To pay the owners of the schooner N. S. Gallup one-half of the“N. S. Gallup,” schooner. damages resulting from a collision with the United States ship Kearsarge off the entrance to Narragansett Bay, August twenty-1872fourth, nineteen hundred and five, one thousand one hundred and five dollars and fourteen cents.
To reimburse the crew of the Coast and Geodetic Survey steamship“Pathfinder.”Reimbursing crew. Pathfinder for personal goods and effects lost as the result of a collision between the navy launch Balanga and a cutter in tow of the steam launch of the steamship Pathfinder, seventy dollars and thirty-three cents. To pay Thomas P. Curran, of San Francisco, California, damagesThomas P. Curran. as the result of a collision between his yawl Ripple and the navy-yard fire boat Leslie in San Francisco Harbor on June fifth, nineteen hundred and seven, seventy-eight dollars.
To pay Terry B. Gordon, of Norfolk, Virginia, damages as the resultTerry B. Gordon. of a collision between his yacht Naiades and navy-yard launch Numbered Two hundred and ninety-one at Norfolk, on November sixth, nineteen hundred and seven, one hundred and fifty-five dollars and twenty cents. To pay the owners of the barge Hatteras damages as the result of“Hatteras,” barge. a collision with the naval training station launch Resolute, in the harbor at Newport, Rhode Island, on March thirtieth, nineteen hundred and six, one hundred and eighty-three dollars and fifty-three cents.
To pay the owners of the steamship Fortuna damages as the result“Fortuna,” steamship. of the United States ship Whipple fouling her anchor chain in the harbor at Port of Spain, Trinidad, on December twenty-fourth, nineteen hundred and seven, two hundred and fifty dollars. To pay M. McDonald, of Port Blakeley, Washington, on account ofM. McDonald. the cost of repairs to his wharf at Pleasant Beach, Washington, damaged by the United States ship Sotoyomo in February, nineteen hundred and eight, one hundred and thirty-three dollars and ninety-nine cents.
To pay the owners of the lighter Norfolk, damaged as the result of“Norfolk,” lighter. her collision with the United States ship Traffic in the North River, New York Harbor, on April twenty-first, nineteen hundred and eight, two hundred and one dollars and fifty-four cents. To pay the owners of the gasoline launch damaged as the result of“West Virginia,” U. S. S.Collision damages by barge of. a collision with the steam barge of the United States ship West Virginia in the harbor at the navy-yard, Mare Island, California, on August twelfth, nineteen hundred and eight, fifty-four dollars.
To pay the owners of the steamship Florence Witherbee damages“Florence Witherbee,” steamship. to the amount of one-half the value of their vessel, which was sunk as the result of a collision with the United States ship Accomac in the harbor at Pensacola, Florida, on February fourteenth, nineteen hundred and seven, two thousand five hundred dollars. To pay Richard Jones, ordinary seaman, United States Navy, onRichard Jones. account of the loss of certain of his personal effects while he was being transferred, by order of his commanding officer, from the United States ship Washington to the United States naval hospital, Mare Island, California, on February twenty-sixth, nineteen hundred and eight, thirty-nine dollars and forty-five cents.
To pay the owner of the Chesapeake canoe Walter Reed damages on“Walter Reed,” canoe. account of the collision with the steam launch of the United States ship Chicago at Annapolis, Maryland, on November fifteenth, nineteen hundred and eight, one hundred and twenty-two dollars and seventy-nine cents. To pay, upon the presentation of satisfactory evidence of interest“Menawa,” schooner. in each instance, the claims arising out of the collision between the United States ship Mayflower and the schooner Menawa, in Long Island Sound, on July twenty-second, nineteen hundred and eight, the payments being in full for, and the receipt of the sums to be taken and accepted in each case as a full and final discharge of the respect-1873tive claims, twelve thousand three hundred and fifteen dollars and twenty-seven cents.
To pay the California Transportation Company, San Francisco,California Transportation Company. California, damages on account of the collision between their steamship Constance and the United States ship Vigilant off pier Numbered Three, Washington street, San Francisco, California, on July twenty-first, nineteen hundred and eight, thirty-one dollars and eighty cents. To pay the owners of the British steamship Vienna damages on“Vienna,” steamship. account of injuries suffered while discharging coal alongside the United States ship California in Magdalena Bay, Mexico, on November eleventh, nineteen hundred and eight, one hundred and twenty dollars.
To pay the State Transportation Company, New York, New York,State Transportation Company. damages on account of injuries suffered by their barge Hustler while being moved from one berth to another by the United States ship Pentucket at the navy-yard, New York, New York, on January twenty-eighth, nineteen hundred and nine, thirty dollars. To pay the Susquehanna Coal Company, of New York, New York,Susquehanna Coal Company. damages on account of the collision between their barge Malvern and the United States ship Lebanon in Boston Harbor, on January twenty-third, nineteen hundred and nine, seventy-five dollars.
To pay to the owner of the Uruguayan bark Maria damages on“Maria,” hark. account of the collision between his vessel and the United States ship Panther in the harbor at Gibraltar, Spain, on January thirtieth, nineteen hundred and nine, two thousand six hundred and seventy-six dollars and sixty-two cents. To pay the Baltimore Steam Packet Company, Norfolk, Virginia,Baltimore Steam Packet Company. damages on account of the collision between their steamship Gaston and the United States ship Mohawk in the harbor at Norfolk, Virginia, on March thirteenth, nineteen hundred and nine, one hundred and ninety-eight dollars.
To pay the owners of the British steamship Strathdee damages on“Strathdee,” steamship. account of the collision with the United States ship Fortune in Magdalena Bay, Mexico, on March twenty-third, nineteen hundred and nine, six thousand four hundred and ninety-six dollars and eighty-nine cents. To pay the following-named persons damages on account of destructionTorpedo boats.Destruction of fishing nets by. of fishing nets by United States torpedo boats: John McIntyre, forty dollars;
Thomas J. Lopez, seventy dollars; Manuel V. Silver, eighty dollars; William Wareham, sixty dollars; Joseph E. Kenney, fifty dollars; Edwin W. Smith, sixty-five dollars; in all, three hundred and sixty-five dollars. To pay Rear-Admiral Giles B. Harber, United States Navy, onGiles B. Harber. account of the settlement by him of the claim of the Chinese customs service arising out of a collision between the United States ship Denver, attached to the Third Squadron, United States Pacific Fleet, and the Kiangyin light-boat in the Yangtse River, China, on July sixteenth, nineteen hundred and nine, one hundred and forty dollars and eighty-two cents.
To pay Croswell Brothers, of Crisfield, Maryland, damages onCroswell Brothers. account of the collision between their sloop, the Mary F. Croswell, and the United States ship Nina in Chesapeake Bay, on October fourteenth, nineteen hundred and eight, two hundred and sixteen dollars. To pay E. R. Mason, New York, New York, damages on accountE. R. Mason. of the collision between his motor boat and a steam launch of the United States ship Mississippi on September thirtieth, nineteen hundred and nine, sixty-seven dollars and twenty cents. 1874 To pay the Egerton Towing Company, New York, New York, damagesEgerton Towing Company. on account of the collision between their tug Hiawatha and the United States ship Powhatan in the East River on January second, nineteen hundred and nine, three hundred dollars and eighty-two cents.
To pay Wright and Cobb Lighterage Company, New York, NewWright and Cobb Lighterage Company. York, damages on account of the collision between their lighter Jane and the United States ship Pawnee in Wallabout Basin, Brooklyn, New York, on November eighth, nineteen hundred and nine, one hundred and seventy-nine dollars and sixty-eight cents. To reimburse Paymaster Henry de F. Mel, United States Navy,Henry de F. Mel. for amount disallowed by the Auditor for the Navy Department on account of payment made by him to the owner of a boat damaged by a steam launch from the United States ship New York in the harbor at New York on June first, nineteen hundred and nine, twenty-five dollars.
To pay the Boston Tow Boat Company, Boston, Massachusetts, onBoston Tow Boat Company. account of damages suffered by their tug Orion as the result of a collision with the United States ship Iwana, at Quincy, Massachusetts, on April tenth, nineteen hundred and ten, forty-eight dollars and forty cents. To pay the Coastwise Dredging Company, Norfolk, Virginia, forCoastwise Dredging Company. damages resulting from the collision between their scow numbered Twenty-two, while in tow of the tug H.
A. Baxter, and the United States ship Louisiana in the harbor at Norfolk, Virginia, on January twenty-second, nineteen hundred and ten, six hundred and ninety dollars and sixty-six cents. To pay the George M. Morrell Company damages on account ofGeorge M. Morrell Company. the collision between their barge, the W. S. Wolle, and the United States ship Pontiac in Wallabout Channel, navy-yard, New York, on March twenty-first, nineteen hundred and ten, two hundred and forty-six dollars and sixty-two cents.
