CHAP. 448.— An Act For the relief of the owners of the American schooner Wilson and Hunting and cargo. June 25, 1910.[[H. R. 4093](/us/bill/61/hr/4093).][[Private, No. 137](/us/pvt/61/137).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That the claims of the owners of “Wilson and Hunting,” schooner. Claims for damages, collision with U. S. S. “Culgoa,” referred to New York southern, district court.the American schooner Wilson and Hunting and of the cargo on board of her, sunk by collision with the United States steamship Culgoa, off Barnegat, New Jersey, on or about November ninth, nineteen hundred and four, for and on account of the loss of the said vessel and cargo, may be submitted to the United States district court for the southern district of New York, under and in compliance with the rules of said court, sitting as a court of admiralty, and the said court shall have jurisdiction to hear and determine any suits brought, and to enter a judgment or decree for the amount of any damages for the loss of the said vessel and cargo, if any shall be found to be due, against the United States, upon the same principles and measure of liability, with costs as in like cases in admiralty between private parties, and with the same rights of appeal: *Provided,* That the amounts of the losses *Proviso.* Losses of officers and crew.sustained by the officers and crew of the said schooner Wilson and Hunting may be included in the decree of the owners of the said vessel.
Sec. 2.That notices of the suits shall be given to the Attorney-General Defense.of the United States and to the Secretary of the Navy, as may be provided by the order of the said court, and it shall be the duty of the Attorney-General to cause the United States attorney to appear for and defend the United States. Sec. 3.That should damages be found to be due the said owners of Appropriation for paying judgment.said schooner Wilson and Hunting and cargo, the amount of the final decrees therefor of any or either of them shall be paid out of any money in the United States Treasury not otherwise appropriated: *Provided, also,* That such suit shall be brought and commenced within *Proviso.* Time of suit.four months from the date of the passage of this Act.
